Terms and Conditions

These Terms and Conditions apply to contracts for the purchase of digital products, particularly digital knitting and crochet patterns, offered through my website and concluded via Payhip.

The subject matter of the contract is the purchase of digital content, particularly PDF files containing knitting and crochet patterns, as well as any supplementary digital content where applicable.

These are exclusively digital products. No physical item will be shipped.

The presentation of products on my website does not constitute a legally binding offer but rather an invitation to submit a purchase offer.

The ordering and payment process takes place via Payhip. The conclusion of the contract is governed by the ordering process displayed there and the acceptance of the order.

The version of these Terms and Conditions agreed upon at the time of conclusion of the contract shall apply.

All prices are stated in euros. The total price applicable to the order, including any taxes that may apply, is displayed during the checkout process.

Payment processing takes place via Payhip and the payment methods offered there. The terms of the selected payment service provider may also apply.

Digital content is generally made available immediately after successful completion of the purchase process, either as a download or through access provided by Payhip.

Temporary technical restrictions may occur, for example due to maintenance or disruptions affecting third-party providers. Statutory rights in the event of improper delivery remain unaffected.

I make every effort to present my products and content as accurately as possible.

Product images are provided for illustrative purposes. Colours and visual representations may vary slightly depending on the screen or device used.

In individual cases, digitally enhanced product images or images created with the assistance of artificial intelligence may also be used for visual presentation. The digital patterns themselves are not altered as a result.

The respective product description and the agreed characteristics of the digital product remain decisive. Statutory warranty rights are not restricted by the visual presentation.

Upon purchase, you receive a non-exclusive, non-transferable right to use the purchased digital pattern for personal purposes.

Unless expressly stated otherwise for a particular product, the following activities are not permitted:

• Sharing the digital pattern with third parties.
• Reselling the file.
• Unauthorised publication, reproduction or distribution of the pattern or substantial parts of it.
• Presenting or distributing the pattern as your own or as a modified digital product for sale.

Mandatory statutory rights of use remain unaffected.

The digital products offered, particularly patterns, texts, images, graphics and layouts, are protected by copyright in accordance with applicable law.

The purchase does not transfer any copyright. Only the right of use described in these Terms and Conditions is granted.

The statutory warranty provisions apply, including the provisions governing digital services and digital content.

I prepare my patterns with great care. However, should a digital product be defective, please feel free to contact me.

Whether a defect exists is determined in accordance with statutory provisions and the agreed and objectively required characteristics of the product.

I am liable for damages in accordance with applicable statutory provisions.

Mandatory statutory liability claims, particularly those relating to personal injury, intentional misconduct or breaches of essential contractual obligations, remain unaffected.

Consumers generally have a statutory right of withdrawal within 14 days of the conclusion of a distance contract.

For digital content not supplied on a tangible medium, this right may expire early if the statutory requirements are fulfilled.

In the case of a paid contract for the supply of digital content not provided on a tangible medium, the right of withdrawal may expire early if the statutory requirements have been met.

In particular, you must have expressly consented to performance beginning before the end of the withdrawal period and acknowledged that you will thereby lose your right of withdrawal. The legally required contract confirmation must also be provided.

The necessary declarations must be properly obtained during the checkout process.

Refunds are governed by applicable statutory provisions, particularly those concerning the right of withdrawal and warranties for digital services.

If the right of withdrawal has validly expired in accordance with statutory requirements, there is no longer a statutory right to withdraw on that basis.

Statutory rights relating to defective files, improper delivery or other warranty claims remain unaffected.

Austrian law shall apply, excluding the conflict-of-law provisions of private international law and the United Nations Convention on Contracts for the International Sale of Goods.

For consumers whose habitual residence is in another country, mandatory consumer protection provisions of that country remain unaffected.

I am neither obliged nor willing to participate in voluntary dispute resolution proceedings before a consumer arbitration board.

Mandatory statutory obligations remain unaffected.

Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

Invalid provisions shall be replaced by the applicable statutory rules.
